| Abstract | ||
| Liberty is a precious thing that can be clearly felt when it is restricted. It is concerned with the dignity of the individual and represents a source of value to him. The restriction upon liberty is only justified in case of public interest of the whole community. The development of a society is measured on the basis of its protection of liberty and freedom given to its members and the guarantees that are given to the individuals according to the legislation. The individual's arrest is one of the important issues that is related to the rights and liberties. It is one of the most dangerous procedures in the investigation that threatens the personal liberty which is considered a natural right that gives him the right of movement. According to the international charters, conventions, and constitutions, it is prohibited to restrict liberty except for the cases that legislations permit. | ||
