Abstract | ||
Establishing a system of administration of justice at the United Nations is considered a new system discussed by the General Assembly since 2006 to be an alternative to the old system of internal administration of justice to resolve administrative disputes among the international staff and management in the United Nations represented by the UN administrative tribunal. The General Assembly under resolution 253/63 in 2008 issued this system and identified the first of July as a valid date to apply it. The new internal administration justice system consists of two phases. The first phase is called the informal system of internal administration justice which means the possibility of resolving the legal administrative disputes between the international staff and management in the United Nations through non-judicial means by seeking dispute resolution to submit disputes to mediation under the auspices of the Office of the Ombudsman. The second phase is the formal system of internal administration justice, when the parties to the conflict resorting to the informal system fail to resolve the dispute through the mediation, then the judicial resolution becomes the right option to resolve the dispute in front of the United Nations Dispute Tribunal as the first instance tribunal. With the possibility to appeal the provisions of this tribunal before the United Nations Appeal Tribunal as the second instance tribunal within the United Nations internal administration justice system after following the special procedures to move the lawsuit before these tribunals as mentioned in the statute of the United Nations for each tribunal. All of the above was the subject of this research, which consists of two sections; the first section is dedicated to the definition of the United Nations internal administration justice system, and the second section is dealt with the procedures of implementing the United Nations internal administration justice. | ||
