Abstract | ||
Electronic negotiable instruments are relatively recent in commercial transactions, whether in domestic internal trade or in international cross-border trade. Due to their novelty, we have clarified the concept of electronic negotiable instruments by defining and explaining their nature, as well as the most important characteristics of this type of dealing in negotiable instruments according to the comparative jurisprudential and legislative concept. The trading of electronic negotiable instruments carries several risks. We have clarified the most important of them, and we have also referred to the most prominent means through which those risks that surround dealing with electronic negotiable instruments can be avoided. The importance of the issue of electronic commercial papers is evident in modernity in all societies, which represent a tangible scientific reality in the advanced information life of societies, which has become a reality through the transformation into a database and a digital economy to increase productivity, speed the transfer of capital, and loyalty between dealers. The study aims to explain the most important risks that surround such transactions in electronic commercial papers, via the international information network, which relate to financial brokerage companies on the one hand and the electronic carrier on the other hand. | ||
