| Abstract | ||
| This research deals with the rules regulating the patent, regarding the objective and formal conditions to acquire it, the granted rights and imposed obligations by it, and the causes of their expiration. Showing that despite of national and international endeavors, the legislators didn’t reach to adjust and stabilize the rules ensuring the treatment of all the matters ramified from the problems surrounding the patent. Attaining to the recommendations that the researcher believes must be taken into consideration to resolve these matters and problems. The research problem lies in the fact that, despite all the national and international efforts exerted for decades, legislators in general, including the Iraqi legislator, have not succeeded in controlling and establishing the rules to address all the complex issues of the invention and to solve the problems surrounding the patent that the inventor deserves to reach, including He refused a request to grant it to her. | ||
