| Abstract | ||
| The criminal case passes through independent stages, each of them from the other, and that the parties who own it and dispose of it differ from one stage to another. Evidence is available against them, but the practical reality has shown us many mistakes that the trial courts make by issuing judgments, most of which are overturned by the courts of cassation (cassation) and the reason for this is the lack of analysis and discussion of the evidence, especially in terms of clarification to the parties to the criminal case, The reason for this may be due to several factors that lead to this happening, which requires attention and highlighting.
